Terms and Conditions

1. Introduction
These are our general terms and conditions between KiddiChef.com (UK) Ltd (“kiddichef.com” or “us”) and any person who buys any product or products from us (“the Customer” or “you”). KiddiChef.com (UK) Ltd is a company registered in England and Wales registered number 08172293, VAT registration number to be advised. Please ensure that you read and understand these terms and conditions before you order from us as you will be bound by them once a contract comes into existence between us.

3. Health
We strongly recommend that you should seek medical advice before your child or you starting our nutritional programme. The information provided by KiddiChef.com is not medical advice or a substitute for medical treatment. You should not use KiddiChef.com if you are having any medical condition which affects your dietary requirements. You must carefully consider the ingredients in our meals and daily guide menus. Daily guide menus are for guide purposes only

4. Orders
By completing the website order form or placing an order by telephone you are making an offer to purchase goods. We may refuse to accept an order for any reason (including if goods are not available, we cannot authorise payment, there has been a pricing or product description error, or if you are not eligible to buy KiddiChef.com products). Your offer is accepted by us and our contract concluded when we send email order confirmation to you. Any products which we have not confirmed in the email will not form part of the contract. The Pay Monthly Contract is a contract between us for the recurrent delivery of goods rather than a series of separate contracts. We do not accept orders from addresses outside the European Union. The minimum initial Pay Monthly Contract is 6 months from first order. You can decrease the ordered quantity with prior notice 4 weeks. You can place add on orders with lead time 2 days.

5. Delivery
It is agreed that anyone at the delivery address is entitled to accept delivery. The courier will attempt to deliver once. If all attempts to deliver the goods fail they will be returned to us. In those circumstances we will not issue any refunds. You will be liable to pay for the cost of returned goods to us. Delivery charges apply.

6. Guarantee
Our food is freshly prepared every day with advised one day shelf life, and we encourage you to consume on the day of delivery or as specified on the label.

7. Monthly Contracts
Our Pay Monthly Contracts, which are for the repeat delivery of KiddiChef.com meals on a monthly basis, have an initial minimum contract term as specified in point 4. Orders. After that initial minimum contract term, your Pay Monthly Contract will continue until such time as you cancel it. You may cancel your Pay Monthly Contract within 28 days after the initial minimum contract term by giving us no less than 28 working days prior notice (to allow us to cancel the packaging and dispatch of your next monthly package). You may also reschedule delivery of any of your Pay Monthly package by up to 28 days (through our website or by calling us) – again we need 2 working days prior notice.
Where special offers are contingent upon purchase of a Pay Monthly product, which is subsequently cancelled prior to completion of minimum contract term, KiddiChef reserves the right to demand full payment for stated product and/or offer.

8. Prices
All prices quoted include VAT where applicable. It is always possible that, despite our best efforts, some of the goods we sell may be incorrectly priced. We will normally check prices as part of our dispatch procedures so that, where the goods’ correct price is less than our stated price, we will charge the lower amount when dispatching the goods to you. If the goods’ correct price is higher than the stated price, we will normally, at our discretion, either contact you for instructions before dispatching the goods, or reject the order and tell you. If the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as an error, we do not have to provide the goods to you at the incorrect (lower) price.

9. Data Protection Statement
The personal data collected by us from you, may be utilised by us to: (i) manage the delivery of goods to you, (ii) pass information about you to our agents, advisors and employees to carry out services for us, (iii) notify you about enhancements to our services such as: functionality changes to the website, new services and special features, and offers or competitions we think you will find interesting, (iv) market our products and services and those of any third parties and (v) contact you by mail, telephone, email, text message, or any other reasonable method.

10. Information about you and your visits to our site www.kiddichef.com
We process information about you in accordance with our privacy policy (policy is available on www.kiddichef.com). By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

11. Uploading material to our site www.kiddichef.com
Whenever you make use of a feature that allows you to upload material to our site, or to make contact with other users of our site, you must comply with the content standards set out in our acceptable use policy (policy is available on www.kiddichef.com).You warrant that any such contribution does comply with those standards, and you indemnify us for any breach of that warranty.
Any material you upload to our site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.
We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our site.
We have the right to remove any material or posting you make on our site if, in our opinion, such material does not comply with the content standards set out in our acceptable use policy (policy is available on www.kiddichef.com).

12. Virus, hacking and any other offences www.kiddichef.com
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

13. Linking to our site www.kiddichef.com
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link from any website that is not owned by you.
Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with the content standards set out in our acceptable use policy (policy is available on www.kiddichef.com). Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

15. Jurisdiction and applicable law
The English courts will have [non]-exclusive jurisdiction over any claim arising from, or related to, a visit to our site [although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country].
These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

We may revise these terms and conditions with notice period of 28 days.
